PRESS RELEASE: Court of Appeal affirms conviction of Life Imprisonment on a rapist
The Court of Appeal of Nigeria Kano Division presided by Hon Justice (Dr) Hussein Mukhtar has yesterday being Tuesday, the 8th day of June, 2021, affirmed the conviction and sentence for life imprisonment on one Auwalu Shu’aibu who was convicted by the Jigawa State High Court No. 2 sitting at Dutse. The sentence was earlier handed down on the man by Hon Justice Ahmed Isah Gumel (rtd) in the year 2019 for the offence of Rape of a 4-years old girl. The offence which was punishable under Section 283 of the Penal Code (Miscellaneous Amendment) Law of Jigawa State, 2014, was committed at Dunnaka Village of Miga Local Government Area of Jigawa State.
The Appellate court in a considered judgment delivered online via GoogleMeet app by three Justices of the Court of Appeal has found and held that the Respondent team led by Hon. Attorney-General Jigawa State, Dr Musa Adamu Aliyu, had established the ingredients of the offence of Rape and that the appellant has failed to show why the decision of the lower court was perverse. The appeal therefore lacks merit and was unanimously refused. The appellate court therefore affirmed the conviction and sentence of the High Court which sentenced the convict to life imprisonment for the offence of Rape of the 4-year old girl.
