Jigawa High Court Sentences Man to 3 years imprisonment for armed robbery, acquits 3 others charge for Culpable homicide.
Jigawa High Court of Justice sitting at Gumel presided by Hon. Justice M.A Sambo on 6th September, 2021, has delivered Judgment against one Sa’idu Haruna of Dawanbiri Fulani Settlement of Gamji Village Gagarawa Local Government Area to 3years imprisonment and a fine of 30,000 found guilty of the offence of Armed Robbery contrary to Section 298(1)(b) of the penal code law.
In order to proof the case, the prosecution called Three(3)witnesses and the defendant testified in his defense. The court having satisfied with the prosecution had proved its case beyond reasonable doubt and found Sa’idu Haruna guilty of the offence of Armed Robbery, thereby sentenced him to 3years imprisonment for the offence of Armed Robbery and Ordered him to pay the sum of #30,000 Naira as compensation to the victim or in default to serve another 3years imprisonment. Both sentences shall run concurrently from the date of his first detention in connection to the charge.
Delivering another judgment at Gumel High Court, Justice M. A Sambo has On Monday 13th September,2021 delivered judgment in favour of the following defendants: Audu Ibrahim, Ali Baso and Tambai Ali charged for Criminal Conspiracy and Culpable Homicide.
The brief fact of the case was that: Saminu Sani (the deceased) and the defendants attended a wedding ceremony at Yola Fulani Settlement Kaya Village in Babura L.G.A and on their way back home Saminu Sani (the deceased) had a quarrel with one Lawal Giyya the brother to one of the defendant (Tambai Ali).
While quarreling, Lawan Giyya was beaten up by the deceased, whom in retaliation the three defendants beats the deceased (Saminu Sani) which resulted to his death.
During the trial, the prosecution called (3) witnesses and tendered extrajudicial statements of the defendants in evidence, and Medical Report as exhibit P. On the other hand, the 3 defendants testified in their defence and tendered 1 exhibit.
In his judgement Hon. Justice Abubakar Sambo found that none of the offences of Culpable Homicide was established against the three defendants by the prosecution, because of the existence of contradiction in the evidence of 2nd Prosecution Witnesses who in the Court claim to be eye witness but in his statement to the police he said he was informed by one Abdullahi Haruna.
