Jigawa High Court Sentences Man to Life imprisonment for rape, acquits another charge with Culpable homicide.
The Jigawa High Court Sitting in Birnin kudu, Presided by Justice Musa Ubale has on 5th October 2021 sentenced one Idris Munkaila to life imprisonment for the offence of Rape contrary to section 283 of the penal code (Miscellaneous Amendment Law) No. 9 2014.
The defendant, from Sara town in Gwaram local government of Jigawa State was said to have rape a 6 year old girl (minor) who is also from Sara Town, same community with the defendant.
During the trial, the Prosecution presented five (5) witnesses and tendered exhibits. The defendant testified as sole witness in his own defense. Delivering the judgment, Justice Musa Ubale held that the prosecution had successfully proved its case against the defendant beyond reasonable doubt, hence the defendant had been found guilty of the offence of rape and sentenced him to Life imprisonment for raping a six (6) year old minor (girl).
In another case, Justice Musa Ubale has delivered judgment in favour of one Abubakar Garba charged with the offence of Culpable homicide contrary to section 221(b) of the penal code.
In proving the case, the Prosecution presented two (2) witnesses and tendered some exhibits, while the defendant testified as sole witness in his own defence. In its judgment, the Court held that the prosecution had failed to prove their case beyond reasonable doubt and failed to establish essential ingredients of the offence, the Court thereby discharged and acquitted the defendant.
