Jigawa High Court Dicharges and acquits Seven Defendants Arraign for Rape, Act of gross Indecency and Sodomy.
The Jigawa High Court of Justice sitting in Kazaure Presided over by Honourable Justice Hussaina Adamu Aliyu has on 29th November 2021 delivered six judgments where all the six (6) defendants were discharged and acquitted. The cases in which the defendants were discharged and acquitted are: (1) State v Sulaiman Salisu Charge No. JDU/295C/20, (2) State v Abdullahi Dantsaro charge No: JDU/293C/20, (3) State v Sirajo Ali Charge No JDU/296C/20, (4) State v Ahmed Abdullahi Charge No:JDU/299C/20, (5) State v Jamilu Garba Charge No: JDU/297/20 and (6) State v Hassan Mati Charge No: JDU/294C/20. The facts of the cases were that the defendants have differently alleged to have raped two girls (names withheld) in the cases. The court found that the testimonies of the prosecution witnesses were contradictory and the extra judicial statements of the defendants recorded by the police lacked credibility as such the prosecution had failed to prove their cases beyond reasonable doubt.
In another development, on the same 29th November, 2021, High Court No 7 sitting at Birnin Kudu presided over by Hon Justice Musa Ubale in the case of State v Yusuf Safiyanu Charge No: JDU/356C/2020 had discharged and acquitted one Yusuf Safiyanu alleged to have had carnal knowledge of a boy (names withheld). The court found that the evidence of the prosecution did not establish the case against the defendant.
